Terms of Service

1. Acceptance of Terms

By accessing or using Ponlaya (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

These Terms are read together with our Privacy Policy. References to "we", "us", or "our" refer to Ponlaya.

2. Description of Service

Ponlaya is a free web application that allows authenticated users to generate AI-curated YouTube playlists from natural language prompts, play content via an in-app embedded player, share playlists with collaborators via tokenized links with role-based access (Viewer or Editor), and comment on shared playlists. The Service is provided on an as-is, as-available basis. Features and functionality may change or be discontinued at any time without notice.

3. Eligibility

You must be at least 13 years of age to use Ponlaya. By using the Service, you represent that you meet this requirement. If you are under the age of majority in your jurisdiction, you must have parental or guardian consent.

4. Account and Authentication

Access to Ponlaya requires authentication via Google OAuth ("Sign in with Google"). By signing in, you authorize us to collect your Google account name, email address, and profile information solely for identity verification and session management.

We do not request access to your YouTube account, YouTube playlists, or any private Google scopes beyond: `email`, `profile`, and `openid`.

You are responsible for the security of your Google account. We are not liable for unauthorized access resulting from a compromise of your Google credentials.

5. User-Generated Content

When using Ponlaya, you may submit text prompts for playlist generation, playlist titles, collaborator email addresses, and comments on shared playlists. You retain ownership of any content you submit. By submitting content, you grant Ponlaya a non-exclusive, royalty-free, worldwide license to store, display, and use that content solely to operate and improve the Service.

You agree not to submit content that is unlawful, harmful, abusive, defamatory, infringing, or otherwise objectionable. We reserve the right to remove any content at our discretion.

6. Third-Party Content and Services

Ponlaya integrates with third-party platforms and services to deliver its functionality. We do not host, store, or control content served by these platforms. All such content is subject to the terms of service and privacy policies of the respective providers.

By using the Service, you acknowledge that third-party platforms may apply their own cookies, tracking technologies, and data collection practices to your session, independently of Ponlaya.

We are not responsible for the availability, accuracy, or legality of any content or service provided by third parties accessed through Ponlaya.

7. AI-Generated Content

Playlist suggestions, titles, and song selections are generated using artificial intelligence. AI-generated content is provided for entertainment and informational purposes only. We do not guarantee the accuracy, completeness, or appropriateness of any AI-generated output. Ponlaya does not claim ownership of AI-generated playlist titles or song selections. These outputs are provided to you for personal, non-commercial use.

8. Sharing and Collaboration

You may invite collaborators by email. Collaborators are assigned one of two roles: Viewer, who can view playlist details and tracks, or Editor, who can rename the playlist and post comments. Shared playlist links use unique tokens. You are responsible for managing who has access to your links and may revoke access at any time via Manage Sharing. By entering a collaborator's email, you confirm you have the right to share content with that person in compliance with applicable privacy laws.

9. Prohibited Uses

You agree not to use the Service to violate any applicable laws or regulations, infringe the intellectual property rights of others, submit false, misleading, or harmful content, reverse-engineer, scrape, or exploit the Service or its APIs, resell, sublicense, or commercially exploit any part of the Service without written permission, spam or harass other users via sharing or comments features, or circumvent or interfere with any security feature of the Service.

10. Intellectual Property

The Ponlaya application, its branding, design, and underlying code are the intellectual property of Ponlaya. All rights reserved. Nothing in these Terms grants you any right to use Ponlaya's trademarks, logos, or brand assets.

11. Donations

Ponlaya is free to use. We accept voluntary donations to support its development. By making a donation, you acknowledge that donations are voluntary, non-refundable, and do not constitute payment for any service or feature, and do not grant any special access, rights, or privileges within the Service.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

13. Limitation of Liability

Ponlaya is provided entirely free of charge. We accept voluntary donations but do not charge fees for access to the Service. Accordingly, to the maximum extent permitted by law, Ponlaya and its affiliates shall have no liability of any kind arising from your use of the Service.

14. Termination

We reserve the right to suspend or terminate your access at any time, with or without notice, including for violations of these Terms. Upon termination, your right to use the Service ceases immediately. Sections on intellectual property, disclaimers, limitation of liability, and governing law survive termination.

15. Changes to These Terms

We may update these Terms at any time. Changes will be posted with a revised effective date. Continued use after changes are posted constitutes acceptance. For material changes, we will make reasonable efforts to notify you at the email associated with your account.

16. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Peru. Any disputes arising from these Terms or your use of the Service shall be submitted to the exclusive jurisdiction of the courts of Lima, Peru.
